Welcome to Miami Live Scan and FingerPrinting – Biscayne & 22nd, a service provided by Philip Lilavois, Inc. (“Company,” “we,” “us,” or “our”). By accessing or using our services (“Services”), you (“Customer,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). These Terms govern your use of our Services, so please read them carefully. If you do not agree with any part of these Terms, you must not use our Services.

Description of Services
We offer a comprehensive range of live scan fingerprinting and background check services designed to meet the needs of various professionals and organizations. Our Services include, but are not limited to:
- ATF EFT Live Scan: Electronic fingerprint transmission for Bureau of Alcohol, Tobacco, Firearms, and Explosives applications.
- Department of Business and Professional Regulation (DBPR) Fingerprinting: Fingerprinting services for professionals regulated by the DBPR.
- Department of State Services: Fingerprinting for Department of State requirements, including passport and visa applications.
- FBI Background Checks: Nationwide criminal history checks through the Federal Bureau of Investigation.
- FBI Background Checks for Authorized Recipients: Direct submission of background checks to authorized agencies.
- Fingerprint Cards (Includes Two Cards): Traditional ink or electronic fingerprint cards for professions requiring physical submission.
- Financial Industry Regulatory Authority (FINRA) Fingerprinting: Fingerprinting services for financial professionals requiring FINRA registration.
- Florida Department of Law Enforcement (FDLE) Services (Includes ORI Fee): State-level background checks with the appropriate ORI (Originating Agency Identifier) fee.
- Secure Web Fingerprint Transmission (SWFT) Processing: Electronic fingerprint submission for Department of Defense security clearances.
- Five-Year Archive and Lifetime Archive Services: Secure storage of fingerprint records for future use.
- Medicaid Provider Fingerprinting: Compliance fingerprinting for healthcare providers participating in Medicaid.
- Agency for Persons with Disabilities (APD) Fingerprinting: Fingerprinting for professionals working with individuals with disabilities.
- Department of Children and Families (DCF) Fingerprinting: Services for those involved in childcare and family services.

Eligibility
To use our Services, you must be at least 18 years old and possess valid government-issued identification. By using our Services, you represent and warrant that you meet these eligibility requirements. You agree to comply with all applicable federal, state, and local laws and regulations when utilizing our Services.
Appointments and Scheduling
Appointments can be scheduled online, by phone at 305-834-7379, or in person at our office located at 2125 Biscayne Blvd Suite #303, Miami, FL 33137. While walk-ins are welcome, we recommend scheduling an appointment to ensure availability and reduce wait times.
If you arrive more than 15 minutes late for your scheduled appointment, we may need to reschedule to accommodate other customers. Cancellations must be made at least 24 hours prior to your appointment time. Failure to provide adequate notice may result in a cancellation fee equivalent to 50% of the scheduled Service fee. No-shows may be charged the full Service fee.
4. Customer Obligations
You agree to provide accurate, current, and complete information during the registration and fingerprinting process. Any false statements, misrepresentations, or omissions may result in the termination of Services and potential legal action.
You are responsible for obtaining any necessary authorizations or consents required by law for the Services you request. You agree not to use our Services for any unlawful or fraudulent purposes and not to interfere with or disrupt the operation of our Services. Unauthorized access to data not intended for you is strictly prohibited.
Fees and Payment
Fees for our Services vary depending on the specific Service requested. A detailed fee schedule is available on our website or upon request. All fees are due at the time of Service. We accept cash, major credit cards, and debit cards. Personal checks are not accepted.
All fees are non-refundable unless otherwise stated. Refunds are only issued if we are unable to provide the requested Service due to an error on our part. If you cancel your appointment less than 24 hours in advance or fail to appear for your appointment, cancellation fees as outlined in Section 3 will apply.
Refund Policy
All fees for our Services are non-refundable. In the event that your fingerprint submission is rejected by the requiring agency due to an error on our part, we will gladly redo the fingerprinting service at no additional cost to you. To be eligible for a redo, you must:
- Notify us within 30 days of receiving notice of the rejection.
- Provide official documentation from the agency stating the reason for the rejection.
Please note that we are not responsible for rejections resulting from:
- Inaccurate or incomplete information provided by you.
- Changes in agency requirements after the date of service.
- Poor quality fingerprints due to conditions beyond our control (e.g., worn fingerprints).
It is your responsibility to ensure that all personal information and documentation provided to us is accurate and complete. We recommend verifying all requirements with the requesting agency prior to your appointment.
Confidentiality and Privacy
We are committed to protecting your personal information and privacy. We collect personal data necessary to perform the Services, including but not limited to your name, address, date of birth, Social Security Number, and biometric data such as fingerprints.
Your information is used solely for the purpose of completing the fingerprinting and background check Services you have requested. We may share your data with authorized agencies and regulatory bodies as required to perform the Services or as mandated by law.
We employ industry-standard security measures, including encryption and secure data storage, to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, please be aware that no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

Intellectual Property Rights
All content on our website and within our marketing materials, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of the Company and is protected by United States and international copyright laws.
You are granted a limited, non-exclusive, and non-transferable license to access and use the materials for personal, non-commercial purposes. Any unauthorized use, reproduction, distribution, modification, or creation of derivative works from our content is strictly prohibited and may result in legal action.
Limitation of Liability
Our Services are provided on an “as is” and “as available” basis without any representations or warranties of any kind, either express or implied. To the fullest extent permissible under applicable law, the Company disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
In no event shall the Company, its directors, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your access to or use of the Services, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or your use of the Services shall not exceed the amount you have paid to us for the specific Service giving rise to the claim.
Indemnification
You agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.
Dispute Resolution
These Terms and any disputes arising out of or relating to these Terms or the Services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Miami, Florida, before a single arbitrator. The arbitration shall be administered by the American Arbitration Association under its Commercial Arbitration Rules.
Judgment on the arbitration award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.
Termination
We reserve the right, in our sole discretion, to terminate or suspend your access to all or part of our Services at any time, with or without notice, for any reason, including but not limited to your violation of these Terms.
Upon termination, all rights and licenses granted to you in these Terms will immediately cease. The provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Changes to the Terms
We reserve the right to modify or replace these Terms at any time. Any changes will become effective immediately upon posting to our website. It is your responsibility to review these Terms periodically for any updates or changes. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes.
Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or other tribunal of competent jurisdiction, such provision shall be modified to the minimum extent necessary to render it enforceable without losing its intent, or severed from these Terms if no such modification is possible, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published by us, constitute the entire agreement between you and the Company concerning your use of the Services. They supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and the Company with respect to the Services.
